Before it even hits shelves, Beyonce’s forthcoming fragrance through Coty is facing a hurdle. In a federal lawsuit filed on Tuesday, retailer Abercrombie & Fitch co. claims a fragrance deemed to be labeled “Sasha Fierce” “poses a likelihood of confusion” with its own “Fierce” brand. According to the retailer, the confusion could deprive it of control over a trademark it has used since 2002, and a potential loss of sales. Beyonce unveiled plans to release a fragrance with the help of Coty earlier this week. Following the Platinum plus selling album “I Am…Sasha Fierce,” Beyonce told WWD the fragrance would be in stores in 2010.
Sources say the recently filed lawsuit seeks to halt potential trademark infringement, unfair competition and deceptive trade practices.
Abercrombie claims it has sold over $190 million worth of its own ‘FIERCE’ fragrance since its debut. The fragrance is also the signature scent of Abercrombie & Fitch and is sprayed throughout its stores via a scent machine.
